As a Latino family in California, you work hard every day to give your loved ones a better future. But there's something many families overlook: the legal documents that protect everything they've built.
It's not about being rich. It's about being prepared. Here are the 5 documents every family needs — and why.
1. Living Trust
What is it? A document that establishes how your assets are distributed when you pass away, without going through the court's probate process. Why do you need it? If you own a home in California (or any assets exceeding $184,500), without a Living Trust your family will face:- •12 to 18 months waiting in court
- •$15,000 to $46,000 in legal fees
- •A completely public process
2. General Power of Attorney
What is it? A document that authorizes a trusted person to handle your financial and legal affairs if you cannot do so yourself. Why do you need it? Life is unpredictable. If you have an accident, a serious illness, or simply travel outside the country for an extended time, someone needs to be able to:- •Pay your bills
- •Manage your bank accounts
- •Make decisions about your property
- •Represent you before institutions
👉 Prepare your General Power of Attorney
3. Limited Power of Attorney
What is it? Similar to the general power, but for a specific task and for a limited time. Why do you need it? The most common situations in our community:- •You need someone to sign the sale of your house because you're out of the country
- •Someone needs to go to the DMV for you to transfer a vehicle
- •You need a family member to handle a specific bank transaction
- •You need to send someone to pick up important documents
4. LLC (Limited Liability Company)
What is it? A legal structure that separates your business from your personal assets. Why do you need it? If you have a business — even a small one — without an LLC:- •If someone sues your business, they can go after your home, car, and personal savings
- •Mixing personal and business finances creates problems with the IRS
- •Clients and partners take a business registered as an LLC more seriously
5. Operating Agreement
What is it? The internal document that establishes the rules for how your LLC operates — profit distribution, responsibilities, what happens if a partner wants to leave, and more. Why do you need it? Many people form their LLC but never create the Operating Agreement. This is a serious mistake because:- •Banks may refuse to open your business account
- •If you have partners and there's a disagreement, there are no clear rules
- •You could lose the limited liability protection the LLC gives you
- •The state of California will apply its own default rules

The Cost of Not Being Prepared
| Situation | Without documents | With documents |
|-----------|------------------|----------------|
| You pass away with a home | Probate: $15,000-$46,000 + 12-24 months | Trust: distribution in days, no court |
| You become incapacitated | Court conservatorship: $5,000+ and months | Power of Attorney: immediate action |
| Your business gets sued | They can take your home and savings | LLC: only business assets at risk |
| You need someone to sign for you | Impossible without legal authorization | Limited Power: resolved in one document |
The First Step Is the Most Important
You don't need to do everything at once. Start with the document you need most:
- •Own a home? → Start with the Living Trust
- •Have a business? → Start with the LLC
- •Travel frequently? → Start with the Power of Attorney
- •Need a specific transaction? → Start with the Limited Power
